This page (together with our Privacy Policy, Terms of Use and Acceptable Use Policy tells you information about us and the legal terms and conditions (“Terms”) on which we will provide you with lottery syndicate services.

Please read these Terms carefully and make sure that you understand them, before agreeing to them.

 

How the Contract between You and Us is Formed

To make an Order on our Site, you will be required to set up an Account. You will be asked to agree to these Terms as part of the Account set up process.

Please tick the acceptance box you will be presented with as part of that process if you accept these Terms. If you refuse to accept these Terms, you will not be able to set up an Account or submit Orders.

When you have completed the Account set up process we will send you an email acknowledging that we have received your request to open an Account.  However, please note that this does not mean that your request has been accepted.  Our acceptance of your request will take place as described in the following paragraph.

Once we have received your payment for your first Order (see clause 7 below) we will (unless clause 6.5 applies) send you an email that confirms that we have accepted your Order.  The contract between us will be formed on these Terms when we send you this email. Each Order you make will be subject to these Terms. The process for making an Order is described in clause 6.3.

 

Keeping a Copy of these Terms

You should print a copy of these Terms(or save them to your computer) for future reference.

 

Our Right to Vary these Terms

We amend these Terms from time to time as set out in clause 10.

 

Terms in the English Language

These Terms are only in the English language.

1. Definitions

In these Terms:

"Account" means your account with us;

“Automatic Renewals” has the meaning given in clause 6.8;

“Default Lines” means the Lines of your choosing that we will enter into the relevant Draws each time you place an Order to take part in a particular syndicate;

“Draw” means a lottery draw pertaining to a particular Game which is operated by a Lottery Operator;

“Game” means a game operated by a Lottery Operator subject to particular rules set by the Lottery Operator;

“Line” means a combination of numbers to be entered into a Draw;

“Lottery Operator” means a third party that operates Draws;

“Order” means an order made via our Site for us to purchase lottery ticket(s) with Line(s) of your choice for a given Draw or series of Draws, each Draw pertaining to the same Game;

“Site” has the meaning given in clause 2.1;

“Winnings” has the meaning given in clause 8.1.

 

2. Information About Us

2.1 We operate the website winwin-lottery.com (“Site”). We are New Sport Lotto Ltd, a company registered in England and Wales under company number 7963013 and with our registered office at c/o FKGB Accounting Suite 7 Arkleigh Mansions, 200 Brent Street, London, England, NW4 1BJ. 2.2  We neither promote nor operate a lottery nor do we sell lottery tickets.

3. Use of our Site

Your use of our Site is governed by our Terms of Useand Acceptable Use Policy. Please take the time to read these, as they include important Terms which apply to you.

 

4. How We Use Your Personal Information

 

We only use your personal information in accordance with our Privacy Policy. For details, please see our Privacy Policy. Please take the time to read this, as it includes important terms which apply to you.

 

5. Your Declaration

By accepting these Terms you confirm that you are at least 18 years old.

 

6. How to Play

 

6.1 Through our Site you may join syndicates to take part in particular Draws. Any Winnings attributable to a member of a syndicate will be shared amongst all the members of that syndicate in accordance with clause 8.

6.2 To take part in a syndicate you must place an Order.

6.3 To do this, you must use the functionality on our Site to take the following steps:

6.3.1 choose which Game to take part in;

6.3.2 choose which syndicate(s) entering that Game to take part in or set up a new syndicate (some Games will only have one syndicate, in which case, you will join that syndicate by default unless you set up a new one);

6.3.3 choose or amend your Default Line(s) (see clause 6.7 for more details);

6.3.4 set up an Account, or if you have one, log-in to your existing Account to choose how many consecutive Draws you wish to enter;

6.3.5 make payment; and

6.3.6 submit your Order.

When we receive your payment we will (unless clause 6.5 applies) send you an email confirming your Order, at which point your Order will be deemed accepted.

6.4  After we have accepted your Order, we will purchase lottery tickets for the relevant Draw(s) with the Line(s) you have chosen. You acknowledge that your payment to us is a payment for a service and not for the purchase of lottery tickets in your name and that we retain ownership in the lottery tickets at all times.

6.5 In exceptional circumstances (such as where we suspect any fraud) we may reject an Order. If we do so, we will refund any payments made to us in respect of that Order unless we are forbidden to do so by law.

6.6 In order to take part in a particular Draw or series of Draws you must place your Order by the deadline for that Draw as set out on our Site.

6.7 The Line(s) you choose when you first join a syndicate will be your default Line(s). However, you may also add (or subtract) lines if you wish, in which case the modified set of Line(s) will become your Default Lines for the relevant syndicate. If you wish to change your Default Line(s) (other than by adding to or subtracting from your existing set of Default Lines) you must contact us on _________. You acknowledge that we have sole discretion as to whether to permit you to change your Default Line(s) in this way.

6.8 You may choose to renew your Order automatically (“Automatic Renewals”). Each renewed Order will relate to the same number of consecutive Draws as the original Order and we will purchase tickets with your Default Line(s) for each of those Draws. If you choose Automatic Renewals, your Order will continue to renew automatically until you cancel it. You may cancel Automatic Renewals at any time by contacting us on _______.  See clause 7.3 for information about how we take payment for Automatic

Renewals.

6.9 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.

 

7. Payment

7.1 The price for your Order will be as set out during the Order process. All prices are inclusive of VAT.

7.2  You can pay us using a debit card or credit card,  using Paypal or using any Winnings that you have not yet withdrawn.

7.3 If you choose Automatic Renewals (see clause 6.8), the price for your Order will remain the same each time it is renewed unless we tell you otherwise. We will take payment on ___ using the payment details you gave us when you made your first Order in the series. The name that will appear on your statement following payment is _____.  You may cancel automatic renewals at any time. See clause 6.8 for details.

 

8. Winnings

8.1 Except where the relevant Lottery Operator refuses to pay them for any reason, we will collect any winnings paid out by the relevant Lottery Operator that are attributable to a ticket we have purchased with a Line chosen by a member of a syndicate (“Winnings”).

8.2 Except in the situation envisaged in clause 8.10, members of the syndicate will be entitled to the following percentages of the Winnings:

8.2.1  50% to the member of the syndicate who chose the winning Line; and

8.2.2  40% divided equally amongst each of the other members of the syndicate.

We will retain the remaining 10% of the Winnings.

8.3 You will be able to view the Winnings you are entitled to by logging-in to your Account.  You acknowledge that it may take up to [_____ after the relevant Draw takes place for us to update your Account.

8.4 You may withdraw the portion of the Winnings that you are entitled to at any time after they are displayed in your Account by using the relevant functionality on our Site. When you withdraw Winnings, we will (except where clause 8.10 applies) pay them into the account whose details you gave us when you set up your Account, as subsequently updated. 

8.5 You acknowledge that all Winnings belong to us until you withdraw them.

8.6 If your Account is inactive for _____ we will retain any unclaimed Winnings for ourselves. 

8.7 You acknowledge that we will only be required to pay any Winnings to you if the Lottery Operator pays them out to us. We will not be liable to you if, for any reason, the Lottery Operator does not do this.

8.8 If, for any reason, the Lottery Operator requests a refund from us of any Winnings which were paid to us in respect of a particular Draw you agree:

8.8.1 that we may return any such Winnings you were entitled to that you have not yet withdrawn;

8.8.2 that you will, if we make a written request from you within 1 month of the date you withdrew the Winnings, refund to us within 14 days of the written request an amount equivalent to any such Winnings to which you were entitled that you have withdrawn. 

8.9 If, for any reason, we have paid out an incorrect sum to you, and we notify you of this in writing within 14 days of the payment, you will repay us that sum.

8.10  We reserve the right not to pay any Winnings to you if you are under 18 years of age.

 

9. Cancellation

9.1 You may cancel this contract or a specific Order at any time. To do so, please contact us in writing to tell us by sending an e-mail to ______ or telephoning us on _____.  You may wish to keep a copy of your cancellation notification for your own records. Your cancellation is effective from the date you sent us the e-mail or telephoned us.

9.2 You agree that, at any time after we accept your Order, we may purchase such tickets as are necessary to fulfill your Order and that this will be considered the performance of services for you under these Terms. Accordingly, if you do cancel this contract or a specific Order, we will only refund the proportion of your payments that relate to any Draw for which we have not yet purchased such tickets as would have been necessary to fulfill your Order.

9.3 We will process any refund due to you as soon as possible and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation as described in clause 9.1.

9.4 We may cancel this contract or a specific Order by giving you immediate notice in writing if:

9.4.1 we reasonably consider that any action or omission by you will cause us serious loss or other serious harm;

9.4.2 we disable any user identification code or password relating to your Account under the Terms of Use;

9.4.3 we otherwise deny you access to our Site under the Terms of Use or Acceptable Use Policy; or

9.4.4 if we cease business.

Any notice of cancellation will include the reason why we have chosen to cancel. If we do cancel this contract or a specific Order, we will only refund the proportion of your payments that relate to any Draw for which we have not yet purchased such tickets as would have been necessary to fulfill your Order. We will process any such refund within 30 calendar days of the day we cancel the contract or Order.

 

10.Our Rights to Vary these Terms

10.1 We may revise these Terms from time to time in the following circumstances:

10.1.1 changes in how we accept payments from you; and

10.1.2 changes in relevant laws and regulatory requirements.

10.2  Whenever we revise these Terms in accordance with this clause 10, we will keep you informed and give you notice of this by stating that these Terms have been amended and the relevant date at the top of this page.

 

11. Our Liability

11.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we accepted the particular Order in relation to which the breach occurred.

11.2  We do not in any way exclude or limit our liability for:

11.2.1 death or personal injury caused by our negligence; or

11.2.2 fraud or fraudulent misrepresentation.

 

12. Events Outside our Control

12.1 We will not be liable or responsible for any failure to perform, or delay n performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 12.2. 

12.2 An Event Outside Our Control means any act or event beyond our reasonable control.

12.3 If an Event Outside Our Control takes place that affects the performance of our
obligations in respect of an Order:

12.3.1 we will contact you as soon as reasonably possible to notify you; and

12.3.2 our obligations in respect of the Order will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our ability to purchase particular ticket(s) with the Line(s) you have chosen for a particular Draw or Draws, we will purchase the ticket(s) for the next Draw or Draws pertaining to the relevant Game that take(s) place after the Event Outside Our Control ends. 

 

13.Communications Between Us

13.1  When we refer, in these Terms, to "in writing", this will include e-mail.

13.2 If you wish to contact us in writing for any reason other than to cancel an Order (which is addressed in clause 9.1 above), you can send this to us by e-mail or by pre-paid post to New Sport Lotto Ltd at ____________. You can always contact us using our Customer Services telephone line which is _________.

13.3 If we have to contact you or give you notice in writing, we will do so by e-mail to the address you provided to us when you opened your Account or to any other replacement address you provide us with.

 

14.Other Important Terms

14.1 We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you in writing or by posting on this webpage if this happens.

14.2 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

14.3 These Terms are between you and us. No other person shall have any rights to enforce any of the Terms.

14.4 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

14.5 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. 

14.6 These Terms are governed by English law. This means that any dispute or claim arising out of or in connection with them will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of a different jurisdiction you may bring proceedings in that jurisdiction.

14.7 We will not file a copy of these Terms.
